Board holds off on zoning law amendment

Monday night, the board of trustees held off approving an amendment to the zoning law that would allow residents to rent their homes during the Hall of Fame’s Induction Weekend.

Mayor Carol Waller had said earlier that the change would legitimize a practice that has been going on for years.

The planning board studied the issue and made recommendations for the change to the trustees, but the trustees wanted it to be reviewed by the village attorney before being adopted. It will be on the agenda for the trustees’ May meeting.

If approved, residents would be able to rent their home to visitors for Hall of Fame Induction weekend for a period not to exceed 60 hours and occupancy not to exceed nine people.

The owner of the home would be required to file a signed "Notice of Intent for the Limited Rental of Residence’’ at least 10 days prior to Induction weekend certifying that specific health, safety and fire protection measures will met prior to the rental,

The planning board also recommended eight ``clear and reasonable requirements for a safe home and neighborhood environment’’ that should be included.

The planning board left it up to the trustees to decide if additional provisions should be included to address issues such as noise control, bed tax and insurance.

The trustees also referred a request from the planning board for a two-year ban on outdoor woodburning furnaces to the village attorney.

In a letter to the board of trustees, Planning Board Chairman Teresa Drerup stated the primary reason for the ban is the lack of any current EPA standards regulating emissions from the furnaces.

Drerup’s letter states the board’s research indicates the furnaces tend to produce offensive and noxious emissions of smoke, which is in violation of the village zoning law.

``The planning board unanimously agreed that the current design of the outdoor wood furnaces makes them inappropriate for any location within the village limits,’’ the letter stated.

Drerup said the issue should be revisited in two years when technology or EPA standards may have been implemented that would alleviate offensive smoke emissions.

In other action, the board:

received a report from the Doubleday Field Advisory Committee in which it stated that members rejected the idea of signage on the outfield fence,

learned there have been no specific offers for concerts this year, but concert committee chairman Jeff Katz continues to peak with national promoters,

heard a report from the streets committee which stated a speed bump will be placed on Brooklyn Ave,

approved increases for sewer and water rates,

accepted Smith Ford’s $54,948 bid for a 2008 F750 dump truck,

learned the price of trolley tickets will remain at $3.00 per adult and $1.00 per child,

reviewed and approved the new outdoor vending application and criteria merchants must adhere to,

approved the use of Lakefront Park for the Otsego Lake Festival on July 14.

Next month’s board meeting will be held on Tuesday, May 22 because of the Hall of Fame Game between the Blue Jays and the Orioles scheduled for Monday, May 21.
