Board finalizes recommendation

The planning board finalized its recommendation to the board of trustees for a change in the zoning law to allow for Induction weekend rentals during its meeting Tuesday afternoon.

The board left it up to the trustees and village attorney to decide the exact wording and where the amendment will be inserted into the law, but recommended it contain the following:

residents may rent their home to visitors for Hall of Fame Induction weekend for a period not to exceed 60 hours and occupancy not to exceed nine people,

the owner of the home must file a signed "Notice of Intent for the Limited Rental of Residence’’ at least 10 days prior to Induction weekend certifying that specific health, safety and fire protection measures will be met prior to the rental,

should the rental of the residence exceed 60 hours or nine people, a fire inspection from the Otsego County Code Enforcement Office and a temporary residence permit from the NYS Department of Health will be required.
The board also recommended the creation of a form for the "Notice of Intent for the Limited Rental of Residence.’’ The form includes eight ``clear and reasonable requirements for a safe home and neighborhood environment and should not be altered.’’

The planning board left it up to the trustees to decide if additional provisions should be included to address issues such as noise control, bed tax and insurance.

The eight requirements for the form include:

occupancy will not exceed nine individuals,

all sleeping rooms will be in the primary structure and at least 75 square feet for one guest and 50 square feet for each additional guest, not including bathrooms and closets,

all sleeping rooms will contain a smoke detector, two means of exit and an exit route diagram affixed to the back of the sleeping room door,

dining room, kitchen and bathrooms will not be used as sleeping rooms,

all hallways will contain a smoke detector and in the kitchen a two pound ABC fire extinguisher and a flashlight will be installed,

for emergency use, the 911 telephone number, the 911 residence street number and the residence telephone number will be displayed next to each phone,

a telephone number where the owner can be reached during Induction weekend as well as local contact person and telephone number for repairs will be clearly displayed,

the telephone number where the owner may be reached during Hall of Fame weekend.

The planning board’s recommendations will go before the board of trustees during its next meeting Monday night.
